Who is a controller of Your personal data?

 

The controller of Your personal data is Lynka Sp. z o.o. (Lynka Ltd.)  with a registered office in Skawina, Poland at 16 Majdzika Street, entered into Register of Entrepreneurs of the National Court Register (KRS) under the National Court Register (KRS)  number: 0000139929, e-mail: lynka@lynka.eu, phone number: +48 12 293 80 00 (“the Controller”), that is an owner of the Lynka.eu on-line shop (“the On-line Shop”) maintained at www.lynka.eu (“the Web Site”) Privacy policy

 

Which data is collected by the Controller while signing up, making purchases and for what purpose?

The Controller shall collect from You the following personal data by means of the Web Site and the other communication means, in case of making purchases and signing in process conducted on the Web Site:

1) surname and first name,

2) e-mail address,

3) company’s data:

- name,

- mailing address, address for goods delivery, address for VAT invoice issuance,

- contact phone numbers,

- Tax Identification number (NIP),

- address of web site,

4) industry, in which the company conducts its economic activity,

 
The data shall be performed for the purpose of an execution of Your order. Providing data is voluntary, but necessary for singing in and making a purchase in the On-Line Shop. A basis for processing this data is an agreement concluded between you and the Controller.

 The Controller processes also the data of the persons who contact with the Controller by means of the Web Site in order to obtain an offer. The Controller collects only this data, which enable to get in touch with a person in order to present an offer of the On-Line Shop. A basis for processing this data is to take actions on request of the person prior to a conclusion of the agreement.
If you have given Your consent to receiving commercial information by electronic means (signing up for a newsletter), the Controller processes Your personal data in the form of the E-mail address for the marketing purposes related to the own products of the Lynka Sp. z o.o. company. A basis for processing is Your consent.

 

Which data is collected automatically by the Controller while using the Web Site?

The Controller does not collect automatically any data, excluding the data contained in the cookie files while using the Web Site.  

The cookie files are the small text files sent by the On-Line Shop and stored on Your computer that contain certain information related to using the Web Site and the On-Line Shop by You.

The cookie files used by the Controller can be the temporary or persistent. The session cookie files are deleted upon closing a browser, but the persistent ones are stored also when You cease to use the Web Site within a time period specified in the parameters of the cookie files or until they are deleted. The latter are for storing information, such as Your password or login, what accelerates and facilitates using of the Web Site.

The Controller uses the cookie files for the following purposes:

¾ adapting a content of the Web Site to Your preferences,

¾ developing statistics that facilitate understanding how You use the Web Site, what enables to improve its structure and content,

¾ Maintaining Your session on the Web Site after (You log in) therefore You do not need to re-enter Your login and password on each subpage of the Web Site.

In each case You can disable an installation of the cookie files or delete the persistent cookie files, using the appropriate options of Your web browser. Apart from the cookie files, the Controller may also collect data customarily collected by the controllers of the on-line systems within a frame of a so-called logs or log files.  The information contained in the logs may include, inter alia, Your IP address, platform and web browser type, related to the Internet provider and an address of the web site, from which You have entered the Web Site.

The certain subpages of the web Site and the other means of communication with You may contain the web beacons (so-called graphic images). The web beacons allow for receiving such information as, for instance, an IP address of a computer, to which the web site has been loaded, its URL, a duration of the web site loading, a type of the web browser, as well as the information contained in the cookie files in order to evaluate effectivity of our advertisements. This data shall be archived and used for the purposes of a performance of the statistical analysis and an assumption of the global traffic of the users of the Web Site. This data shall not be combined with the personal data provided by you.

 

How long the Controller shall process Your personal data? 

The Controller shall process Your personal data during a lead time. Upon completion of the execution of the order Your personal data shall be stored within a period of limitation of the potential claims, to which are entitled the contractual parties and for the purposes related to a performance of the statutory obligations.

The data of the persons, who has got in touch with the Controller in order to obtain an offer shall be deleted by the Controller in case of no interest in establishing a further cooperation unless they You give your consent to the further contact on the part of the Controller (e.g. by granting Your consent to sending commercial information).

The personal data that are processed by the Controller on the basis of Your consent shall be stored until a moment of withholding the consent by You.

 

To whom the Controller makes available Your personal data?

For the purpose of an execution of the order, the Controller may make available the collected data to the entities with whom it cooperates on a continuous basis: courier companies, providers of the payment systems, controllers of the web site and to the company that handles the complaints. In these cases, a quantity of the provided data is restricted to a required minimum.

If You give your consent to receiving commercial information, the Controller may make available Your personal data to the advertising agencies that handle sending the newsletters for the marketing purposes.

Security of Your data is a priority for the Controller. While making available Your data, the Controller observes the highest standards, ensuring confidentiality and security of all transferred information. The Controller shall not transfer Your personal data to the entities outside the European Economic Area.

 

How Your data is protected?

Technical means and Your obligations 

The Controller uses every reasonable effort to secure Your personal data and protect it against the actions of the third parties. The Controller applies all necessary safeguards of the servers, connections and the Web Site in order to protect Your data, in particular the access passwords and logins, antivirus safeguards, meets the requirements related to making a copy of the database and makes the backups on an everyday basis.

Nevertheless, the actions taken by the Controller may turn out to be insufficient if You fail to adhere to the security rules. In particular You should maintain confidentiality of Your login and password to the Web Site and do not share them with the third persons. The On-Line Shop shall not request You to provide them, except for entering them during the singing in process on the Web Site. Please, log out after ceasing to use the Web Site in order to prevent from using Your Account by the third parties.

 

To which rights You are entitled in connection with processing Your personal data?

Right to objection

You may object to using Your personal data at any time if the Controller processes Your personal data on the basis of the legitimate interests. If such objection is compliant with the applicable law, the Controller shall cease processing Your personal data for this purpose.

- Right of access

You have a right to receive a confirmation from whether the Controller processes Your personal data or not. If so, you have a right to obtain information about the purposes of this processing, categories of processing personal data or criteria of establishing a time period of this processing, rights, to which the data subject is entitled pursuant to the General Data Protection Regulation (GDPR) and a right to lodge a complaint with a supervisory authority, about a source of this data, a solely automated decision-making, in that profiling and safeguards used in connection with transferring this data outside the European Economic Area. Furthermore, you may obtain a copy of personal data processed by the Controller.

- Right to rectification

At any time, you may correct the data related to You if the personal data processed by the Controller is inaccurate. Moreover, you have a right to complete the incomplete personal data.

- Right to erasure (“right to be forgotten”)

You have a right to request an erasure of Your personal data, in part or as a whole. You are entitled to the right to erasure when:

¾ the consent to processing personal data has been withdrawn,

¾ the personal data are no longer necessary in relation to the purposes, for which it has been processed by the Controller,

¾ it has been lodged an objection to processing, and the Controller has no other legitimate basis for processing personal data,

¾ the personal data has been processed unlawfully,

¾ the personal data have to be erased for compliance with a legal obligation in Union or Member State law to which the controller is subject

In spite of executing the right to be forgotten, the Controller may further process all or a part of the personal data due to, inter alia, the legal obligations imposed on the Controller (e.g. tax obligations) or due to defending or settling any possible claims.

- Right to restrict processing

You are a right to restrict processing Your personal data. It means that You may require to cease processing Your personal data until the request is considered.

You can execute the right to restrict processing when:

¾ You contest the accuracy of Your personal data – then the Controller shall restrict its usage for a period needed to verify an accuracy of Your personal data, however not longer than 14 days,

¾ processing Your data is unlawful, and You oppose the erasure of the personal data and request the restriction of their use instead,

¾ the personal data are no longer necessary for the purposes, for which it has been collected or otherwise processed, but it is needed for the establishment, exercise or defence of Your legal claims,

¾ You have objected to processing pending the verification – then the restriction is applicable for a period needed to consider whether the legitimate grounds of the processing by the Controller override Your interests, rights and freedoms.

- Right of data portability

You have a right to transmit Your personal data. The right of data portability means that You have a right to receive the personal data that You provided to the Controller in a structured, commonly used and machine-readable format. You have also a right to request the Controller to transmit Your personal data to another entity, where technically feasible.

Right to withdraw a consent

You have a right to withdraw a consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

Are You entitled to lodge a claim related to processing Your personal data?

The Controller uses every reasonable effort to secure Your personal data and process it according to the applicable law provisions. If you consider that Your personal data is processed unlawfully, you have a right to lodge a complaint with a supervisory authority, which is the President of the Protection of Personal Data Office, 2 Stawki Street, 00-193 Warsaw, Poland.

 

The other web sites 

Periodically, within a frame of the Web Site may appear the links to the other web sites. These web sites function independently from the Web Site and they are not supervised in any way by the Controller. These web sites can have their own privacy policies and we recommend to read them. The Controller disclaims any responsibility for the rules of proceeding with the personal data within a frame of these web sites.
